Arbitration
Expert Services International provides arbitration services for commercial, construction and infrastructure disputes. Our arbitrator holds the Fellowship (FCIArb) and Diploma in International Commercial Arbitration (DipICArb) from the Chartered Institute of Arbitrators, and brings to each appointment a combination of technical industry knowledge and an understanding of the procedural and evidentiary frameworks governing arbitral proceedings.
We accept appointments as sole arbitrator, presiding arbitrator and co-arbitrator. Appointments are accepted by agreement of the parties, by nomination from appointing bodies including the Resolution Institute and ACICA, and under the rules of international arbitral institutions. We are available for domestic arbitrations in Australia and international arbitrations seated across multiple jurisdictions.
Arbitration Practice
We accept arbitral appointments across a broad range of commercial and technical disputes.
Contractual disputes, claims for damages, disputes arising from joint ventures, partnership agreements and supply arrangements.
Disputes arising from building, civil engineering and infrastructure contracts, including payment claims, variations, delay, defects and termination.
Disputes arising from major infrastructure programmes, mining and resources projects, energy and industrial developments.
Fast-track and documents-only procedures for disputes where the parties seek a binding determination within defined timeframes and at proportionate cost.
International arbitrations conducted under the rules of the ICC, SIAC, HKIAC, ACICA and under the UNCITRAL Arbitration Rules, across seats in Australia, Asia and the United Kingdom.
Case Management
We place considerable emphasis on active case management to ensure that arbitrations are conducted efficiently and at proportionate cost. Early procedural conferences establish a realistic timetable, identify the key issues in dispute, and determine the most appropriate procedures for their resolution — whether that involves oral hearings, documents-only determination, or a combination of both.
We are experienced in managing disputes involving expert evidence, including the direction of concurrent expert evidence and joint expert conferences, and are familiar with the expert witness protocols applicable across multiple jurisdictions.
Credentials
Our principal holds the Fellowship (FCIArb) and Diploma in International Commercial Arbitration (DipICArb) from the Chartered Institute of Arbitrators, together with Fellowships of the RICS, CIOB and Resolution Institute, qualifications in construction, quantity surveying and management, and a Master of Laws in International Commercial Law. He serves as Chairman of the Construction Arbitration Centre (Asia Pacific) and chairs a number of dispute resolution committees.
